Meet Jordan

Jordan is an astute litigator with excellent judgment, described by his peers as “unimpeachably smart, really cool, calm and collected. He comes across well beyond his years” (Benchmark Litigation, 2023). Clients rely on Jordan for his steady approach and strategic insight. Jordan has a reputation as a highly capable and meticulous legal advocate among clients and peers alike, and he has been recognized as a Benchmark “Future Star” and one of Best Lawyers Canada’s “Ones to Watch” in Corporate and Commercial Litigation.

Jordan acts for businesses, individuals and public authorities in all manner of civil litigation. He regularly appears on the Commercial List in Toronto on complex business and contractual disputes, and has extensive experience handling administrative and regulatory matters, and internal investigations. He counsels clients at all stages of litigation, from pre-litigation advice and investigation through settlement and final appeals. He has appeared as lead counsel before all levels of Court in Ontario, including on numerous appeals before the Court of Appeal and Divisional Court.

Jordan has particular experience working with regulated professionals. As a “lawyer’s lawyer”, he has defended professional negligence claims against lawyers (or worked to prevent claims) for most of his career. He also regularly works with accountants, physicians, pharmacists, and early childhood educators in defending civil and regulatory proceedings through to hearing, and responding to investigations.

Jordan’s dedication to advocacy started at the University of Toronto’s law school, where he was awarded the faculty’s student advocacy award and was an oralist in the faculty’s Grand Moot. 

Prior to founding Ivanov Katz LLP, Jordan was a partner at Adair Goldblatt Bieber LLP, one of Canada’s leading litigation boutiques. Jordan also previously practiced as a lawyer and articled in the litigation department of McCarthy Tétrault LLP. In a previous career, Jordan was an economic development consultant for municipalities and public agencies across Canada.

Jordan has spoken in continuing professional development programs and law school classrooms on advocacy and litigation issues. He has remained involved in coaching and judging student moot programs, and actively supports and mentors junior members of the litigation bar.

– Part of a team acting for the primary defendants in multi-billion dollar litigation involving allegations of fraud against a former public official in the Saudi Arabian government, including complex Charter and Evidence Act issues, challenges to Mareva orders, and privilege and production disputes

– Acted for a cannabis retailer in obtaining the discharge of certain financing obligations to enable corporate expansion

– Acted for a pharmaceutical company in a private arbitration relating to the interpretation and breach of a licence agreement

– Acted for the successful applicants in this highly contentious and bitterly disputed oppression application, securing wide-ranging relief including declarations validating their contested shareholdings, declaring that the respondent CEO had caused the Company’s business and affairs to be carried out oppressively, and removing the respondent CEO as director and CEO of the Company

– Counsel to a physician in a shareholder dispute relating to the dissolution of private ENT and cosmetic clinics

– Obtained a favourable settlement for two radiologists in a shareholder dispute relating to private MRI clinics in the GTA

– Acted for a grocery chain in a private arbitration relating to the dissolution of a joint venture for a tenant-anchored commercial plaza in Mississauga

– Counsel to a developer/entrepreneur in a brokerage fee dispute relating to the redevelopment of the Hotel Waverly property in Toronto

– Acted as repair counsel to plaintiffs’ lawyers in several actions to successfully resist defendants’ motions to permanently stay proceedings for failing to immediately disclose the plaintiffs’ settlements with co-defendants.

R. v. Clottey, 2018 ONCJ 536
– Acted as co-counsel in securing an acquittal in favour of a physician facing multiple charges under the Criminal Code, following an 18-day criminal trial.

Ontario Physicians and Surgeons Discipline Tribunal

Acted for numerous physicians in successfully responding to standards of practice and conduct allegations, and in negotiating or securing favourable penalty outcomes

CPA Ontario Complaints

Successfully obtained the dismissal of complaints against multiple accountants and accounting firms with no further action being taken

– Assisted in prosecutions by external counsel before the College’s discipline committee
– Counsel to members seeking reviews of College Committee decisions to the Health Professions Appeal and Review Board

Farej v. Fellows, 2022 ONCA 254
– Co-counsel at the Ontario Court of Appeal in medical negligence case, where the Court held that the trial judge’s reasons for decision were deficient, and successfully overturned the trial decision dismissing the action

Stirrett v. Cheema, 2020 ONCA 288
– Acted for a consortium of medical researchers who were granted intervenor status in this appeal regarding the scope and application of medical researchers’ duties to participants in medical research trials.

Bergmanis v. Diamond, 2021 ONSC 2375
– Acted for one of the respondent lawyers in a long-running arbitration related to the payment of referral fees between personal injury law firms, successfully moving before the arbitrator to quash a summons against the lawyer on privilege grounds, and then successfully resisting the appeal of that decision

Mamado v. Fridson, 2018 ONCA 806
– Acted for a plaintiff in successfully resisting an appeal of a jury verdict in her favour at a personal injury trial

College of Physicians and Surgeons of Ontario v. Peirovy, 2018 ONCA 420
– Part of a team acting for a physician in successfully resisting a revocation order at the Ontario Physicians and Surgeons Discipline Tribunal. After the Divisional Court allowed an appeal from that penalty, the Ontario Court of Appeal overturned the Divisional Court’s decision and reinstated the original penalty decision. The decision was notable for its important guidance on the standard of review applicable to penalty decisions of administrative tribunals.

Preemptive Remedies

– Obtained the appointment of an interim Monitor to supervise and safeguard business operations in the midst of competing oppression applications

– Successfully obtained a Mareva injunction to freeze the assets of a Nigerian national who misappropriated nearly $3 million from a landscaping and snow-clearing business

– Successfully moved to vary a Mareva injunction to release frozen funds for the payment of a defendant’s ongoing living and legal expenses

– Responded to a motion for a Norwich order to limit the terms and conditions under which a lawyer was required to disclose contents of a client’s mortgage file

Advice & Opinions

– Retained by public regulator in confidential mandate to provide opinion on investigatory issues

– Retained by counsel to provide drafting and research services for contested motions and appeals

Inquests & Inquiries

– Counsel to physicians in multiple coroner’s inquests held before juries relating to in-custody deaths
